Article 40 was put into the contract in 1987 to give UPS flexibility to expand its air operations which were just getting off the ground.
Thirty-five years later, UPS profits from air operations are soaring but the loopholes in Article 40 remain.

End Split Wages
Combo air drivers get different pay rates when they are driving or doing inside work. They deserve a single pay rate just like 22.3s.
Teamsters under Article 40 only get a 3-hour guarantee. This contract, we can win a daily guarantee equal to part-timers in the ground operation. A 3½ or 4-hour guarantee would make part-time air workers eligible for a full-year of pension credit.
Air drivers should receive overtime pay on a 6th punch, regardless of how many hours they’ve work. Part-time air drivers should receive overtime pay after 5 hours, like other part-timers.
